About these terms
These terms are an agreement between you and Breukr, based in the Netherlands (“we”, “us”). They apply when you download, install or use the Shotbolt app for macOS. By using the app you accept these terms. If you do not accept them, do not use the app.
You are licensed to use Shotbolt; you do not buy the software itself.
The Personal license
The Personal license is a one-time purchase at the price shown at checkout (list price $15; launch offers may be lower) and includes free updates for all 1.x. That means:
- You pay once. There is no subscription for the Personal license.
- It is a lifetime license. Here that means the right to keep using the version you bought, plus all 1.x updates. The license does not expire.
- Every 1.x update is included at no extra cost.
- A future major version (2.0) may be a paid upgrade. If it is, we expect to offer existing owners a discount. The 1.x version you bought keeps working either way.
What the license allows
A Personal license is for one person. It works on one Mac at a time; a license for 2 Macs (Shotbolt for 2 Macs) works on two Macs at once, which is the most one license covers. The license is personal: do not share it with other people. A Mac that several people use needs a license for each person who uses Shotbolt on it.
You can move your license to another Mac at any time, at no cost: choose Deactivate This Mac in the app's License window, or free the Mac in the customer portal, then enter your key on the new one.
The app activates your key online once and checks it again about once a day. It keeps working offline for up to 30 days between checks.
Unless we agree otherwise in writing, you may not:
- share, sell, rent or give away your license key;
- reverse engineer, decompile or modify the app, except where the law allows it regardless of this restriction;
- remove or work around any license check or notices in the app.
Using it for work
You may use a Personal license for work, including paid work. This applies to freelancers and to employees who are the main user of a Mac, including a Mac provided by an employer or client.
If an organization buys licenses for 5 or more people, it should use a Business license instead.
Business licenses
We plan to offer Business licenses for organizations later. They are not on sale yet. When they are, they will come with their own terms, which will be published here. To be confirmed
Buying a license
Licenses are sold through Polar, which acts as reseller and merchant of record. Your purchase contract is with that company, which handles payment, invoicing and sales tax under its own terms. Prices are in US dollars and include VAT; where available, checkout shows the amount in your local currency, such as euros in the EU. After your purchase you receive your license key by email.
Before you buy, every feature works for 2 days of use. After the trial, capturing and editing stop until you enter a license key; your history and existing captures stay available.
Refunds
If Shotbolt is not right for you, you can get a full refund within 14 days of purchase. No questions asked. Email support@shotbolt.app and we will arrange it. The refund is handled through Polar, the merchant of record, and goes back to the payment method you used. A refunded license may no longer be used.
This refund promise comes on top of your statutory rights, such as the right of withdrawal for consumers in the EU. It does not limit them.
Acceptable use
Use Shotbolt lawfully. You are responsible for what you capture, record and share, including respecting other people's privacy and rights, and any rules that apply where you work. Do not use the app to record people or content without the permission the law requires.
Intellectual property
Breukr owns the app, its code, design and the Shotbolt name and logo. These terms do not give you any rights to them beyond the license described above.
What you create with Shotbolt, your screenshots, recordings and annotations, belongs to you. We claim no rights to it and, since it stays on your Mac, we do not receive it. See the privacy policy.
Warranty disclaimer
We work hard to make Shotbolt reliable, but beyond your statutory rights we provide the app “as is”. To the extent permitted by law, we make no other promises about it: we do not guarantee that it will be free of errors, work without interruption or suit your particular purpose, and we disclaim implied warranties such as merchantability and fitness for a particular purpose. Keep copies of captures that matter to you.
If you are a consumer, you keep the statutory rights you have under the law of your country, including the rights to conformity of digital content under EU law. Nothing in these terms limits those rights.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, such as lost data, lost profit or business interruption. Our total liability for any claim connected with the app is limited to the amount you paid for your license.
These limits do not apply to:
- loss caused by our intent, gross negligence or conscious recklessness;
- death or personal injury;
- your statutory rights to conformity of the app as digital content;
- any other liability that cannot be limited or excluded by law.
Governing law
Dutch law applies to these terms. Disputes go to the competent court in the Netherlands.
If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live, whatever these terms say. If you live in the EU, you may also bring a claim in the courts of your own country.
If you live in the United States, nothing in these terms limits rights that cannot be limited under the law of your state. Some states do not allow certain warranty disclaimers or liability limits, so parts of the sections above may not apply to you.
Changes to these terms
We may update these terms, for example when new license types become available. We will publish the new version here with its date. Changes do not take away rights you already have under a license you bought.
